（中央社記者陳至中台北8日電）媒體報導，有公司要求7月8日颱風假沒上班的人，統一調班至7月10日。勞動部推薦今天表示，未事先徵得勞工同意，雇主片面公告不具效力。

勞動部說，依據「天然災害發生事業單位勞工出勤管理及工資給付要點」，因天然災害未出勤，不能歸責於勞工，也不能視為曠工、遲到，或是強迫以事假或其他假別處理，強迫勞工補班。

勞動部指出，雇主片面公告變更工作日與休息日，公告應屬「無效」，勞工如果體諒雇主趕工的需求，於該日出勤，應算是「加班」，可依法領加班費。

勞動部表示，颱風天勞工是否出勤，應以安全為首要考量，如果有違反「勞動基準法」規定的狀況，勞工可撥打「1955」專線申訴。勞動部會即時實施勞動檢查，保障勞工權益。1050708
